These Terms & Conditions (“Terms”) govern your access to and use of the Dama Tile website, product catalog, and wholesale services (collectively, the “Services”). By accessing the Services, creating a dealer account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

Dama Tile is a wholesale porcelain and ceramic tile distributor. Access to pricing, availability, and ordering features may require an approved dealer account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to provide accurate and complete information when registering and to keep your account information up to date. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or unauthorized purposes.

Product descriptions, specifications, images, and quantity-on-hand figures are provided for convenience and may not always reflect real-time inventory. Tile is a natural and manufactured product; color, shade, size, and finish may vary between production runs and from the images displayed. We recommend confirming availability and ordering from the same production lot for large projects. We reserve the right to modify or discontinue any product without notice.

All prices are wholesale prices intended for approved dealers and are subject to change without notice. Prices do not include applicable taxes, freight, or handling unless otherwise stated. In the event of a pricing error, we reserve the right to cancel or refuse any order placed at the incorrect price, even after an order has been submitted.

All orders are subject to acceptance and product availability. We may limit or cancel quantities purchased per order or per account. Payment terms are established at the time of sale, and title to goods passes to the buyer upon full payment. You are responsible for any applicable sales or use taxes.

Unless otherwise arranged in writing, orders are picked up by the customer at our warehouse. Customers are responsible for inspecting products at the time of pickup and for the safe transport and handling of purchased materials.

Returns are governed by our Return Policy. In summary, returns are accepted within 15 days of purchase, subject to a 30% restocking fee. Boxes must be unopened and undamaged, and customers must bring returns to the warehouse.

The Services and products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Dama Tile disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Any manufacturer warranties, where applicable, are passed through to the customer subject to the manufacturer’s terms.

To the maximum extent permitted by law, Dama Tile shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, arising out of or related to your use of the Services or products. Our total liability for any claim shall not exceed the amount paid for the product giving rise to the claim.

All content on the Services, including logos, text, images, and product data, is the property of Dama Tile or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content without prior written permission.

We may update these Terms from time to time. Changes are effective when posted on this page. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
